What is a Lasting Power of Attorney?

A Lasting Power of Attorney (called Power of Attorney in Scotland) is a legal document that enables you to nominate a person or people to support you make decisions or to make decisions in your best interests if you lose capacity to make decisions for yourself. There are two different types of Lasting Power of Attorney, one for Health and Welfare and one for Property and Finance. 

To make a Lasting Power of Attorney you must be over the age of 18 and have appropriate mental capacity. To be valid a Lasting Power of Attorney must be registered with the Office of the Public Guardian.
